1. Definitions

• “Owner” means [Company Name].

• “Hirer” means the person or entity hiring the Equipment.

• “Equipment” means the goods described in the Hire Agreement.

• “Hire Period” means the period from delivery/collection until return and acceptance by the Owner.

2. Hire Agreement

2.1 The Owner agrees to hire the Equipment to the Hirer subject to these Terms.
2.2 The Hire Period begins on delivery or collection and ends when the Equipment is returned and accepted by the Owner.
2.3 Minimum hire periods may apply.

3. Payment

3.1 Hire charges are as set out in the Hire Agreement.
3.2 Payment is due [in advance / within X days of invoice].
3.3 Late payments may incur interest at [X%] per month.
3.4 The Owner may require a security deposit.

4. Delivery and Collection

4.1 Delivery and collection charges may apply.
4.2 The Hirer is responsible for safe access to the delivery location.

5. Use of Equipment

The Hirer must:

• Use the Equipment only for its intended purpose.

• Operate it safely and in accordance with manufacturer instructions.

• Ensure operators are properly trained and qualified.

• Not modify, tamper with, or sublet the Equipment without written consent.

• Comply with all applicable laws and regulations.

6. Maintenance and Breakdown

6.1 The Hirer must keep the Equipment in good working order (fair wear and tear excepted).
6.2 The Hirer must immediately notify the Owner of any breakdown or damage.
6.3 The Hirer must not attempt repairs without authorization.

7. Loss or Damage

7.1 The Hirer is responsible for loss, theft, or damage during the Hire Period (excluding normal wear and tear).
7.2 The Hirer shall pay for repair or replacement costs where applicable.
7.3 The Owner may require the Hirer to maintain adequate insurance.

8. Title

Ownership of the Equipment remains with the Owner at all times.
The Hirer shall not sell, pledge, or encumber the Equipment.

9. Inspection

The Owner may inspect the Equipment during the Hire Period upon reasonable notice.

10. Termination

10.1 The Owner may terminate the agreement immediately if:

• The Hirer breaches these Terms.

• Payment is overdue.

• The Equipment is misused.

10.2 Upon termination, the Hirer must immediately return the Equipment.

11. Liability

11.1 The Equipment is provided “as is.”
11.2 The Owner is not liable for indirect or consequential losses.
11.3 Liability is limited to the total hire fees paid, except where prohibited by law.

12. Indemnity

The Hirer agrees to indemnify the Owner against claims arising from misuse, negligence, or breach of these Terms.

13. Governing Law
